The general terms and conditions of sale of AKOR SA (trade register number: CH-645.4.101.384-2) for the use of  

Article 1: Area of application

The purpose of these general terms and conditions of sales is to govern the relationship between: the company AKOR SA, 2400 Le Locle, and the Internet user who has accepted the general terms and conditions by becoming an member, hereinafter referred to as the customer.

Article 2: Modification of the general conditions

AKOR SA reserves the right to adapt or modify these general terms and conditions of sales at any time. In case of modification, the general terms and conditions of sales in force on the day of the said order will be applied to each order. 

Article 3: Products

3.1 AKOR SA offers online sales of its watches manufactured in Switzerland under the brand name AKOR registered with the Swiss Federal Institute of Intellectual Property under number 717000. 

3.2 AKOR SA cannot be held responsible for the misuse of items purchased by its customers.

3.3 AKOR watches purchased on have a free right of return of 14 days from the date of delivery. (Art.10) 

Article 4: Services and product guarantee

4.1 The products sold are described on the website at the time of sale. The characteristics of the products as well as the photos correspond to reality. As the reproduction of colours on a computer screen is not perfect, AKOR SA does not guarantee that the colour of the goods is exactly the same as that appearing on the screen.

4.2 All AKOR watches are guaranteed for 2 years from the date of purchase.

4.3 AKOR SA will only accept returns under warranty if the items had been notified in advance and for which a return authorization has been sent by email. The seller declines all responsibility in the event of any accident, in particular if it results from inappropriate use of the equipment.

4.3.1 Limitation of the warranty: improper handling, improper use of the product or improper storage are not covered by the warranty.

 4.3.2 The warranty claim is established between AKOR SA and the buyer only. Repairs, returns or exchanges of products will be fully covered by AKOR SA

 4.3.3 With regard to watches, batteries and other parts subject to natural wear and tear (e. g. wristbands, etc.) are excluded from the warranty claim.

Article 5: Availability of products

5.2 The status of the stocks is displayed in real time.

5.3 When the product is exhausted, the word "exhausted" is displayed on the offer.


Article 6: Prices and charges of delivery For customers domiciled in Switzerland, the prices quoted are net prices in Swiss francs, including VAT. 

6.1.2 For international customers, the prices quoted are net according to the currency chosen by the customer, including VAT. International customers will have to pay nothing more than the online sales price. AKOR SA takes care of the customs clearance of its products for international destinations. 

6.2 AKOR SA reserves the right to modify the prices at any time, but agrees to apply the prices displayed at the time of the order. 

6.3 Delivery and return costs are fully covered by AKOR SA.

6.4 In the event of an unclaimed order from our delivery service provider, AKOR SA keeps the product in stock and at the customer's disposal for a maximum period of three months.

Article 7: Conclusion of the sale

7.1 The sale is concluded when the customer has validated his basket by clicking on the "order" button and when the payment has been made. To this end, as soon as the payment is registered with AKOR SA, the buyer will receive a confirmation of sale (invoice) by e-mail. This e-mail constitutes a sales contract between AKOR SA and the buyer. The latter may only be challenged within the limits provided for in these general terms and conditions. The order is therefore confirmed and cannot be cancelled.

7.2 To place an order, the customer must be of legal age (18 years old) and not be under guardianship or curatorship. The customer ensures that all information transmitted is in accordance with reality.

Article 8: Payment terms and confidentiality

8.1 In order to simplify the purchasing process for customers, AKOR SA offers several payment alternatives through its online payment provider SIX.

8.2 By paying with a credit card, the customer will be redirected to a secured online payment site. No additional charges related to payment by credit card will be added to the order.

8.3 Information related to the means of payment used is not communicated to AKOR SA. The transaction is transmitted directly and securely to our online payment provider SIX, without AKOR SA or third parties having access to it.

8.4 The ordered items are only taken into account once the payment has been received and validated by AKOR SA. A confirmation is then sent to the customer's e-mail address and the product(s) will be sent to him/her in accordance with the deadline mentioned on the offer.

Article 9: Delivery terms and deadlines

9.1 The ordered products are shipped to the delivery address indicated by the customer during the ordering process.

9.2 Delivery times are indicated on the product page for information only. AKOR SA endeavours to respect these deadlines but cannot be held responsible for any delays by its delivery service provider.

9.3 In the event of late delivery, AKOR SA is under no obligation to pay compensation.

9.4 In the event that, after a period of 3 weeks after the scheduled delivery date, AKOR SA is unable to deliver to the customer, the company will refund the amount of the order in the form of purchase orders or by return transfer to the customer's bank account, within 1 month.

9.5 In the event that the customer enters an incorrect delivery address, AKOR SA is not obliged to contact the customer for re-shipment. The additional costs of return management and forwarding will be charged to the customer for a flat-rate amount of CHF 30.

9.6 In the event of the customer's absence at the time of delivery, the customer is requested to take the necessary steps with the transport company (Swiss Post, DHL or others) to collect his package, within the specified time limits. In the event that the package is returned to AKOR Sa, the customer will be charged the cost of managing the return and re-shipment for a flat-rate amount of CHF 30.

9.7 AKOR SA declines all responsibility in the event of loss or damage to the parcel by the transport company; likewise, AKOR SA does not enter into any liability in the event of theft once the parcel(s) have been deposited in the mailbox or in front of the door of the house.

9.8 If you receive a damaged cardboard box, please report this damage directly to your post office within eight days of delivery. Swiss Post/DHL will draw up a report and then check whether you are entitled to compensation for the damage (according to the general conditions of Swiss Post or DHL)


Article 10: Right of return and refund

10.1 Any complaints or retraction must be made within 14 days of the delivery date. Complaints can be made by email or telephone.

10.2 The return costs will be paid by AKOR SA. Warning: the goods must be new, not worn or washed, in their original condition, including the original labels and packaging (s) and returned with the invoice. The original packaging of the product must not be used as return packaging. 

10.3 The warranty on the items only works if the item is returned in its entirety and in its original condition (packaging, accessories, warranty card).

10.4 Any claim for a product under warranty will be processed within an average of 2 weeks.

10.5 In the event of a return in accordance with paragraph 10.2 above and provided that a new product cannot be delivered, the total amount of the order will be refunded by bank/postal return.

10.6 In the event that the claim has been converted into a refund, the product that is the subject of the claim must be returned to our stocks before the refund is granted.

10.7 In the event of the customer's death, his family may request reimbursement of purchases made if they have not yet been delivered to the purchaser's home or if they comply with our above conditions. AKOR SA will refund the amount of the order by postal/bank return.

10.8 If the refund is granted by the AKOR SA after-sales service, the maximum refund period is 3 weeks.

Article 11: Purchase Order

11.1 AKOR SA

 vouchers entitle customers to discounts on all offers in the online shop.

11.2 The use of purchase vouchers when placing an order on AKOR SA's websites is only possible insofar as the customer has acquired a purchase voucher on his account.

11.3 The deadline for the use of a voucher is one year.

11.4 Purchase vouchers may not be refunded, exchanged, assigned or sold.

11.5 If the order is cancelled or if the goods are returned, the amount used via the purchase order will be reissued via the issuance of a new electronic purchase order.


Article 12: Conditions of use of the site

12.1 Customers who do not comply with these general conditions will be excluded from AKOR SA's online services. The Company reserves the right to delete its customers' accounts at any time, with immediate effect, without having to justify its decision.

12.2 Any order concluded in an abusive manner is liable to prosecution in accordance with Articles 146 and 147 of Swiss law.

Article 14: Applicable law and jurisdiction

14.1 The relationship between AKOR SA and the customer is governed by Swiss law.

14.2 In the event of a dispute, the place of jurisdiction is Neuchâtel.
